General Terms and Conditions
We get it. Rules can be a bit boring. But we just need to run a few things by you before we can send you out on your fitness journey.
The first thing to say, is welcome to the group. We are glad to have you with us.
MoGym is a 24-hour 7 day a 7-day-a-week (24/7) facility for our members including public holidays.
New members can register on our Website anytime and gain immediate access through a PIN code. Your Door access will be immediately activated, and you shall use your member ID and PIN code to enter.
New members may also register on premises Monday-Friday: 7:00 am-7:00 pm, Saturday: 8:00 am-12:00pm.
Your membership card will be activated on premises during staffed hours. You can bring proof of membership and your ID to access the facility during staffed hours to validate activation of your membership card.
GYM ETIQUETTES
- Towels should be used at all times, for hygiene reasons.
- Normal footwear must be removed outside & sports shoes must be worn for workouts.
- Getting non-members along is not permitted and may be subject to membership termination.
- Do not open the door for anyone.
- Do not block the equipment, please share.
- Rerack the weights back in the right place after use.
- Do not drop/throw weights on the floor.
- Please wipe down the machines after your workouts using the wipes provided at the facility. It is the individual user’s responsibility to clean up cardio equipment for excessive sweating.
- It is a unisex gym, please maintain discipline.
- Respect the Team and Staff – They are here to help you.
- Smoking, including e-cigarettes, is not something we want in any area of the gym. Any member found to be breach of this rule may have their membership terminated.
MEMBERSHIP TERMS AND CONDITIONS
- You agree to abide by the rules of conduct, behaviour, dress code, equipment usage and use of services that are displayed within this Gym and that have been provided to you.
- You agree that the membership fees are not refundable, and you agree and understand that non-usage of the gym does not allow early termination of this agreement, nor does it warrant a refund of any type. You also agree to understand that non-usage of the gym does not affect any payment terms and conditions of this agreement and that MoGym Fitness Ltd is in no way responsible for your level of usage of the gym and you understand that it is not the responsibility of MoGym Fitness Ltd to notify you of your non-usage.
- Memberships are non-transferable. Members cannot transfer or allow their children and/or any other family members or Friends to use their Membership at any time. You fully understand and accept that if you provide access to the gym for a member, non-member or a member who has lost or damaged their Personal Card (PAC), that have my membership immediately cancelled and you may be charged a penalty of Rs 5,000/- which will be invoiced to me and you are liable to pay under the terms of this agreement, you understand that this policy is applicable regardless of whether the person provides access to exercises or not.
- MoGym Fitness Ltd may at their discretion block access to any Plus Fitness gym or terminate any membership agreement without notice for any non-compliance of this agreement or any behaviour or action that they deem inappropriate.
- You understand members are not permitted to bring children below 12 years into the gym, nor are they permitted to leave children unattended in the area at any time and that MoGym Fitness Ltd accepts no responsibility for children either bought into the gym or left in the gym by a parent or a guardian.
- You fully understand I am solely responsible for any damage that you may cause to MoGym Fitness Ltd facilities, services, products, or equipment if such damage is caused by my wilful act and/or negligence.
- You are fully aware that MoGym Fitness Ltd operates 24/7 and is equipped with Video Surveillance technology which is constantly recording for the security of the gym and that the Video Surveillance can be remotely viewed at any time by the gym operator and/or security provider.
- By joining MoGym, you acknowledge that you are aware of the inherent risks of injury or ill health resulting from the use of the services and from participation in exercise generally in consideration of participation in activities within MoGym Fitness Ltd 24/7, you agree to release and indemnify the gym. You agree to participate in all activities at your own risk and responsibility whether supervised or not by Staff. You agree to release and hold harmless MoGym Fitness Ltd and any associated parties from and against all actions, which may be bought by you or on behalf of your respect of any incident arising out of injury, loss, damage or death caused to you or my property in any way what so ever.
- At MoGym Fitness Ltd we take your privacy seriously. We do not pass your information on to any other business. If you do not wish to receive an email, SMS, or mail correspondence from us regarding your membership, special offers, promotions, or your health then please send us an email or letter confirming that you wish to unsubscribe from such methods of communication.
- Price of our standard membership (monthly non-subscription access) and the price of subscription membership (monthly recurring subscription) are different, and members must check their invoice to confirm if they have purchased the correct product.
- The personal membership access card is not refundable and if lost a new card must be purchased from the Gym reception for Rs. 500/-.
- For safety reasons, we ask you not to bring bags onto the gym floor. Feel free to use the lockers provided, but please only use them for the duration of your training session. MoGym Fitness Ltd is not responsible for any loss or damage to my property when using the gym or the lockers, including my mobile phone, wallet, headphone, bag or other.
- It not permitted to change the music or volume of music in the gym and that MoGym Fitness Ltd retains full control over this system which is managed by its Team.
- Two dedicated parking lots will be provided. Parking spaces are subject to availability, members are required to follow building as well as traffic rules for Parking. MoGym is not responsible for any damage or tow of your personal vehicle.
Payment
We accept multiple modes of payment such as Credit Cards, Debit cards, Bank transfers Juice. All payments by are secured by SSL (Secure Socket Layer).
Mogym.mu processes payment through MIPS MyPay who does not store card details. MIPS My Pay is a PCI (Payment Card Industry) compliant payment ecosystem.
When you choose an online payment option, your card information is securely processed through the payment gateway of our bank partners, Mauritius Commercial Bank (MCB) or ABSA Mauritius Ltd (ABSA).
Rest assured that your card is safely encrypted.
Your use of MoGym facility, its website, and any dispute arising from such use are subject to the laws of Mauritius.
Photo and videos
You are welcome to take photographs and video recordings on the gym floor for your own personal use. Just make sure to stick to these rules and any extra rules displayed on the gym floor:
• Anyone who appears in your photographs or videos must be aware that you are filming them, so make sure to ask their permission first.
• If you are taking photos or recording videos of yourself in our changing rooms, please make sure you do not capture images of another member.
• If another member feels unhappy or uncomfortable that you are filming them and makes a complaint to us, we may ask you to show us any images which you have taken in the gym and to delete them if appropriate.
• If a member of our team asks you to stop filming or taking photographs, please make sure you do.
• Please make sure you never post photographs or videos you have taken on MoGym Group premises on any social media platform with other identifiable people in them, without getting consent from the person concerned that they are happy for it to go onto social media.
ZERO TOLERANCE POLICY
- At MoGym Fitness Ltd, we are dedicated to fostering a supportive and respectful environment for all members and staff. As part of our commitment to creating a positive atmosphere, we enforce a “Zero Tolerance Policy” against any form of rude or abusive behaviour.
- Dignity and respect are one of the most important things to us at The Gym Group so please never behave in an aggressive, abusive, anti-social or threatening manner. We consider any act of harassment, sexual harassment, bullying or victimisation to be in direct conflict with our culture & values. Any breaches of this could result in termination of your membership immediately and we reserve the right to contact the police if we think it is necessary.
- We encourage all members and staff to promptly report any incidents of rude or abusive behaviour to gym management. We are committed to taking prompt and decisive action to address such incidents and ensure the safety and well-being of our community.
- It is important to use your own PIN Code or MEMBERSHIP CARD every time you visit the gym. Both are personal to you, so remember not to let anyone else use them. To keep you all extra safe, we monitor PIN usage through our access control and Camera 24/7, and any misuse may result in memberships being terminated.
Safety/Emergency
- In case of emergency, contact a MoGym employee immediately during staffed hours. The Staff Person will help contact the authorities when it is deemed necessary and provide emergency care if needed.
- During unstaffed hours, you can use the phone located at the front desk to call for an emergency, if deemed necessary.
- In case of fire or alarm, always use caution and safely leave the building.
- Any activity or exercise resulting in pain, faintness, dizziness, or shortness of breath should be stopped immediately.
Cancellations Policy
Our cancellation policy is designed to be fair to all of our members while also ensuring that our gym can continue to operate and provide high-quality fitness services
- Members may cancel their membership at any time, but must provide written notice of cancellation at least 1 week before their next billing date.
- If written notice is not received 1 week before the next billing date, the member will be charged for another month of membership.
- Memberships cannot be placed on hold, but members may freeze their membership for a minimum of one month and a maximum of six months per year due to illness, injury, or other extenuating circumstances. A request must be submitted to freeze the membership 1 week before the next billing date, for a fee of Rs 400 will apply.
- All membership fees are non-refundable and non-transferable.
- After the 6 months freeze period, you will be required to repay the joining fee when re-joining MoGym.
We understand that life can be unpredictable, and we will do our best to accommodate any unforeseen circumstances. If you have any questions or concerns about our cancellation policy, please do not hesitate to contact us. We value our members and are committed to providing the best possible experience for everyone.
COMPLAINTS HANDLING
- Please submit any complaints via email to info@mogym.mu. Please include all the details relating to your complaint. We will do all that is reasonably and practicably possible to assess the merits of the complaint and respond within a reasonable time.
- We have a 48-hour response time policy. We will make sure that someone from our team will reply to your email/quire within 48 hours.
Your use of MoGym facility, its website, and any dispute arising from such use are subject to the laws of Mauritius.
Finally MoGym is to exercise in, not to sleep in. We love having you here, but please make sure to leave the premises when you are done with your workout, and we will see you again next time.
You are now part of MoGym, there to motivate and support you, every step of the way. So however, you want to enjoy the gym, do it in a way that is respectful to everyone!
